1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the NextGen Pros website at nextgenpros.co and our lawn care, pressure washing, and related services (collectively, the "Services").

By accessing our website or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Services after changes are posted constitutes acceptance of the modified Terms.

2. Services Offered

NextGen Pros provides professional lawn care and property maintenance services in Chelsea, Westover, Sterrett, Inverness, and surrounding areas in Alabama, including:

  • Lawn Mowing: Weekly or bi-weekly lawn maintenance
  • Pressure Washing: Driveways, patios, decks, fences, and walkways
  • Pine Straw Installation: Pine straw mulch application for landscaping beds
  • Mulch Installation: Hardwood mulch installation for garden beds
  • Bed Cleanouts: Removal of weeds, debris, and old mulch from landscape beds

Service availability, pricing, and scheduling are subject to change based on weather, demand, and other factors.

3. Service Agreements

3.1 One-Time Services

One-time services are scheduled on a per-request basis. Payment is due upon completion of the service unless otherwise agreed in writing.

3.2 Recurring Services (Subscriptions)

Recurring lawn care services are billed on a subscription basis:

  • Billing Frequency: Weekly or bi-weekly, as selected during signup
  • Auto-Renewal: Subscriptions automatically renew until cancelled
  • Payment Method: Credit card charged automatically via Stripe
  • Service Schedule: Services performed on agreed-upon schedule, weather permitting

3.3 Service Area

We provide services in Chelsea, Westover, Sterrett, Inverness, and select surrounding areas in Alabama. Properties outside our standard service area may be subject to additional fees or may not be available for service.

4. Pricing and Payment

4.1 Pricing

Service prices are based on property size, service type, and frequency. Prices are provided in quotes and confirmed before service begins.

  • Lawn Mowing: Starting at $50/service (varies by property size)
  • Pressure Washing: Starting at $150 (varies by square footage and surface type)
  • Pine Straw/Mulch: Priced per cubic yard plus labor
  • Bed Cleanouts: Priced per bed or hourly rate

4.2 Payment Terms

  • Payment Methods: We accept major credit cards via Stripe
  • One-Time Services: Payment due within 7 days of service completion
  • Recurring Services: Automatically charged to your payment method on file
  • Failed Payments: Services may be suspended if payment fails. A $25 fee may apply for failed payment recovery

4.3 Late Payments

Invoices not paid within 30 days may be subject to a late fee of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less.

4.4 Price Changes

We reserve the right to change our prices at any time. For recurring services, we will provide at least 30 days' notice before any price increase takes effect. Continued use of Services after a price change constitutes acceptance of the new price.

5. Cancellations and Refunds

5.1 Cancellation Policy - Recurring Services

  • Customer Cancellation: You may cancel your recurring service subscription at any time
  • Notice Period: Cancellations must be submitted at least 48 hours before the next scheduled service

  • Effective Date: Cancellations are effective at the end of the current billing cycle

5.2 Cancellation Policy - One-Time Services

  • Cancellations must be made at least 24 hours before the scheduled service time
  • Cancellations made less than 24 hours in advance may be subject to a $25 cancellation fee
  • No-shows (customer not available when scheduled) may be charged the full service fee

5.3 Refund Policy

We strive for 100% customer satisfaction. If you are not satisfied with a service:

  • Quality Issues: Contact us within 48 hours of service completion. We will return to re-perform the service at no charge or issue a refund
  • Partial Refunds: Available for services not completed as agreed
  • No Refunds: Services already completed to satisfaction, weather-related delays (we will reschedule), or customer-caused issues (locked gates, aggressive pets, etc.)

5.4 Company Cancellations

We may cancel or reschedule services due to weather, equipment failure, or other circumstances beyond our control. We will notify you as soon as possible and reschedule at no additional charge.

6. Customer Responsibilities

To ensure safe and effective service delivery, customers agree to:

  • Property Access: Provide clear access to service areas (unlocked gates, clear pathways)
  • Hazards: Notify us of any hazards (underground sprinkler heads, hidden obstacles, aggressive pets)
  • Pets: Secure pets during service. We may refuse service if pets pose a safety risk
  • Water Supply: For pressure washing, provide access to an outdoor water source
  • Parking: Ensure driveways are clear for lawn equipment and pressure washing
  • Accurate Information: Provide accurate property information for quotes

7. Liability and Disclaimers

7.1 Insurance

NextGen Pros maintains general liability insurance for our operations. We are not responsible for pre-existing property damage or damage caused by customer negligence.

7.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • Our total liability for any claim arising from our services is limited to the amount paid for the specific service in question
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not liable for damage caused by weather, acts of God, or circumstances beyond our control
  • We are not responsible for damage to unmarked or improperly marked underground utilities, sprinkler systems, or buried cables

7.3 Service Warranty

We warrant that services will be performed in a professional and workmanlike manner. This warranty is limited to re-performance of services or refund, at our discretion. There are no other warranties, express or implied.

7.4 Property Damage Claims

Any claims for property damage must be reported within 48 hours of service completion with photo evidence. We will investigate and respond within 7 business days.

8. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of NextGen Pros or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

9. User Conduct

When using our website or Services, you agree not to:

  • Provide false or misleading information
  • Impersonate another person or entity
  • Interfere with or disrupt our Services or servers
  • Attempt to gain unauthorized access to our systems
  • Use our Services for any illegal or unauthorized purpose
  • Harass, threaten, or abuse our staff or other customers

10. Dispute Resolution

10.1 Informal Resolution

If you have a dispute with us, please contact us first at contact@nextgenpros.co or (205) 600-3687. We will make every effort to resolve the issue informally.

10.2 Arbitration

If we cannot resolve a dispute informally, you agree that any claim or dispute will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.

Arbitration will take place in Shelby County, Alabama. Each party will bear their own costs, and the arbitrator's decision will be final and binding.

10.3 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

10.4 Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict of law principles.

11. Indemnification

You agree to indemnify, defend, and hold harmless NextGen Pros, its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from your use of our Services, violation of these Terms, or violation of any rights of another party.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NextGen Pros regarding our Services and supersede all prior agreements and understandings.
